Eligibility
To use thealchemy.nyc, place an order, or visit our locations, you must be an adult 21 years of age or older with valid government-issued photo identification per New York Cannabis Law §70(2). New York State law restricts adult-use cannabis to adults 21 and over without exception.
Acceptable identification includes driver's license, state-issued non-driver photo ID, US passport, US passport card, US military ID, IDNYC card, and any government-issued international passport with photo and date of birth. Out-of-state IDs are accepted. Photocopies and digital photos are not accepted; NYS OCM rules require the physical document at point of sale.
If you cannot present valid ID at the door, at checkout, or at delivery handoff, we cannot serve you. We do not accept expired, altered, or visibly damaged ID. We do not accept ID that does not match the customer presenting it. We do not accept a companion's vouch for the customer's age. These constraints are not preferences. They are OCM compliance protocol, and the cost of a bad call on age verification is the license, which is the business.
Account Registration
You may register a customer account at thealchemy.nyc to enable online ordering, loyalty program membership, real-time inventory notifications, and personalized features such as saved delivery addresses and reorder shortcuts. Account registration requires accurate identity information including legal name, date of birth, and contact information.
You are responsible for maintaining the security of your account credentials including the password and any associated two-factor authentication. Notify us at [email protected] if you suspect unauthorized access to your account; we will investigate and take appropriate protective action including a forced password reset if warranted.
You may not register an account if you are under 21, if you have been banned from a NYS-licensed dispensary by OCM action, or if registration would violate applicable law. We reserve the right to refuse account registration or to close an account for any of these reasons or for violation of these Terms.
One account per individual. We do not permit account sharing, account transfer, or account use by anyone other than the registered account holder. Loyalty points and member benefits are tied to the individual account and are not transferable.
Online Ordering
Online orders placed at thealchemy.nyc are subject to age verification at checkout (you must confirm your age and provide ID information at the point of order), ID verification at pickup or delivery handoff (the courier or pickup counter staff verifies the physical ID matches the order), and the daily possession cap of three ounces of flower or 24 grams of concentrate per adult per day under NY Cannabis Law §222(2)(d). Orders that exceed the cap will be modified or rejected at checkout, and the POS will block attempts to stack orders or use multiple visits to circumvent the cap.
Order acceptance is at our discretion. We may modify or cancel an order for any of the following reasons: failure of age verification at checkout, ID verification at handoff, or any subsequent verification step; inventory unavailability for a specific SKU between order placement and fulfillment; payment failure including declined debit cards or rejected cashless ATM transactions; delivery address outside the NYS-licensed service zone (we cannot deliver beyond the zone regardless of distance); detection of fraud including suspicious account behavior, mismatched identity information, or chargeback history; or any other circumstance where fulfillment would violate OCM rules or our compliance obligations.
We do not provide refunds in cash on cancelled cannabis orders. If we cancel an order before fulfillment, the payment is returned to the original payment method through the same processing channel.
Order processing typically completes within 30 minutes to two hours depending on volume and the fulfillment workflow. During peak retail windows (Fridays and Saturdays after 5 pm, 4/20, Pride weekend, Thanksgiving Eve, the December holiday period), processing time may extend to four hours.
Pickup And Delivery
Pickup. Orders are held for pickup for the same business day. Customers must present matching ID at the pickup counter. Orders unclaimed by end of business day will be returned to inventory; refunds for unclaimed orders are processed at our discretion within applicable OCM rules. Pickup hours match storefront operating hours: 10 am to 10 pm Monday through Wednesday and Saturday through Sunday, 10 am to midnight Thursday and Friday. Both locations are closed Thanksgiving Day.
Delivery. Delivery is available within the NYS-licensed service zone under OCM Part 124 (9 NYCRR §124). Delivery fees apply and are shown at checkout. Couriers are NYS Part 124 certified adults 21 and over operating approved vehicles with locked storage compartments separated from the driver compartment. The recipient must present ID matching the order at handoff, and the recipient must be the named customer on the order; we do not deliver to a third-party recipient. If no eligible recipient is available at the delivery address after the courier completes the attempt protocol (two doorbell rings, a phone call to the order contact number, a five-minute wait at the address), the courier returns the order to the dispensary and the customer is notified with options for re-delivery scheduling or order cancellation.
We do not deliver outside the licensed service zone, do not deliver to PO boxes, do not deliver to commercial mail-forwarding addresses, and do not deliver outside New York State. We do not deliver to addresses on the OCM enforcement list. We do not deliver to addresses within 500 feet of school entrances per OCM rule. We do not deliver to hotel addresses where the hotel has not consented to cannabis delivery.
Payment
We accept cash, debit card (with cashless ATM transaction fee that rounds the purchase to the nearest dollar with the rounded difference applied as in-store credit or kept as change), and approved cannabis-banking payment partners where available. Credit card payment for cannabis is not supported per federal banking constraints under cannabis's Schedule I classification (21 USC §812).
All prices include NYS state excise tax (13 percent, composed of 9 percent state and 4 percent local) and local sales tax where applicable. The total at checkout is the total you pay. We do not add surcharges at the register beyond what is displayed at checkout. Optional delivery tips are added separately at the customer's discretion.
Tipping the delivery courier is welcome but not required. Couriers retain 100 percent of tips received through the app or in cash at handoff. The Alchemy does not pool tips across operational staff.
Returns And Exchanges
NYS OCM regulation under 9 NYCRR §113 prohibits return of cannabis once it has left the licensed premises. We cannot accept returns of opened or unopened cannabis products for any reason except where the product is defective on receipt.
Defective product policy. If a product is defective (broken seal at receipt, missing components, manifestly damaged at receipt, or fails to perform per its label in a way attributable to manufacturer defect), notify us within 48 hours of receipt at [email protected] with the order number, the product affected, and a description of the defect. Photo documentation is helpful. We will work with the manufacturer to resolve the defect, including potential exchange or refund where the manufacturer authorizes. The dispensary does not stand behind subjective product preferences (taste, effect, potency perception within labeled tolerance, terpene profile expectation); these are not defect cases. Repeated subjective-complaint returns may result in account review.

Loyalty Program Terms
The Alchemy loyalty program is offered to adults 21 and over who register voluntarily through the website or in store. Points are earned on qualifying purchases at the rate stated on /loyalty/. Tier benefits, redemption thresholds, and any community-specific enhancements (NYU student verification, veteran verification, first responder verification, senior verification) are described on the loyalty page.
Points expire 18 months after the last earning activity if the account is inactive. Points are not transferable between accounts, are not redeemable for cash, and do not have monetary value outside the redemption schedule. Points cannot be combined with certain promotional discounts where stated.
Loyalty program benefits are subject to change with reasonable notice. Major changes (point earning rate, redemption tier values, tier qualification thresholds) will be communicated via email to active members at least 30 days in advance.
The Alchemy reserves the right to terminate loyalty accounts for fraud, abuse, violation of these Terms, or attempted manipulation of the points system. Terminated accounts forfeit accrued points without refund.
Acceptable Use
You agree not to use thealchemy.nyc or our services to do the following.
Violate any applicable law including NYS cannabis regulations under MRTA, federal cannabis prohibition where it affects activities like transport across state lines, NYC ordinances, or any other applicable rule.
Resell cannabis purchased from us. NYS Cannabis Law and OCM rules prohibit resale of cannabis purchased at retail. Resale risks revocation of your account, may have legal consequences under state cannabis law, and undermines the licensed retail framework. We monitor for indicators of resale behavior (unusual purchase patterns, multiple cap-maxing transactions, address mismatch patterns) and we close accounts where resale is established.
Order on behalf of someone other than the named purchaser of the order. The named customer must present ID at pickup or handoff. We do not accept "I'm picking up for my partner" or any similar third-party pickup unless arranged through the documented designated-pickup protocol available for accessibility accommodations on advance request.
Misrepresent your age or identity, present false ID, attempt to use ID belonging to another person, or attempt to evade the age verification protocol in any way.
Attempt to interfere with the operation of the website including denial-of-service attempts, hacking, credential stuffing, scraping at volumes that affect performance, automated cart manipulation, or any unauthorized access attempt.
Use the website to harass, threaten, or harm any person including our staff, other customers, or any third party.
Provide false information in connection with employment application, vendor inquiry, press inquiry, or any other communication with The Alchemy.
Intellectual Property
All content on thealchemy.nyc including text, images, logos, design, product information, photography, video, and the brand identity is owned by The Alchemy NYC or licensed to us by the relevant rights holder. You may not copy, reproduce, distribute, modify, or use our content for commercial purposes without written permission from The Alchemy.
Limited personal use is permitted: viewing the menu, sharing a product page with a friend through standard share functionality, screenshotting your order confirmation for personal records, embedding a product page link in a personal communication. Press use is permitted under the press protocol at /press/ subject to standard editorial fair use and the media kit licensing terms.
Cultivator and processor brand assets (Hudson Cannabis, Florist Farms, Silly Nice, and other named partners) are owned by the respective brand and used by The Alchemy under wholesale partnership agreements. Third-party use of those assets requires permission from the brand owner, not from The Alchemy.
Disclaimers
Cannabis products are sold for adult consumption only. The Alchemy makes no claims that any cannabis product diagnoses, treats, cures, or prevents any disease. Cannabis is not FDA-approved for any medical condition under federal regulatory frameworks. Information on our website about cannabis use and effects is general education, not medical advice. Customers with specific medical questions should consult a licensed medical professional.
The Alchemy provides product information as a service drawn from cultivator and processor documentation, lab Certificate of Analysis records, and our own product literacy. We do not guarantee that any specific product will produce any specific effect for any specific customer. Individual response to cannabis varies based on tolerance, metabolism, set and setting, prior cannabis history, concurrent substances (alcohol, prescription medications, supplements), and other factors.
The website is provided "as is" with reasonable effort to maintain accuracy. We do not guarantee that the website will be uninterrupted or error-free. Real-time inventory may occasionally lag actual shelf inventory due to fulfillment timing; we resolve any discrepancy at the order level.
Limitation Of Liability
To the maximum extent permitted by law, The Alchemy is not liable for indirect, incidental, consequential, or punitive damages arising from use of our services or products. Direct damages are limited to the amount you paid for the specific product or transaction at issue.
Some jurisdictions do not allow limitation of certain damages. Where the limitation is not permitted by applicable law, our liability is limited to the maximum extent permitted by law.
This limitation does not affect rights under New York consumer protection law that cannot be waived by contract.
Governing Law And Disputes
These Terms are governed by the laws of the State of New York without regard to conflict of law principles. Disputes shall be brought in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Before filing a formal dispute, we encourage informal resolution. Email [email protected] with your concern; we typically respond within one business day and work to resolve issues without legal escalation. The store manager and the founding leadership team are reachable through this channel and we take customer concerns seriously.
If informal resolution does not produce an acceptable outcome, the formal dispute path runs through New York courts. Consumer-protection complaints can also be filed with the New York Attorney General's office at ag.ny.gov or with the NYC Department of Consumer and Worker Protection at nyc.gov/dca.
Severability
If any provision of these Terms is held to be unenforceable by a court of competent jurisdiction, the remaining provisions remain in full effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving the original intent.
Modification
We may modify these Terms from time to time. Material changes will be communicated via email to active customers and via a notice on thealchemy.nyc at least 14 days before the effective date. Continued use of our services after the effective date of the modified Terms constitutes acceptance.
Non-material changes (typo correction, clarification of existing terms, contact information updates) may take effect without advance notice. The effective date of the most recent version is displayed at the bottom of this page.
